Christine Korsgaard’s 1996 book, The Sources of Normativity, attracted a great deal of attention. And rightly so. It is a highly engaging attempt to answer what she calls the normative question, which is the question of what could justify morality’s demands. Korsgaard’s latest book, Self-Constitution, develops and defends the broadly Kantian account of action and agency that hovers in the background of Sources, drawing out its implications for the normative question. In this review, we present the main lines of (...) argument in Self-Constitution, raising objections to both Korsgaard’s account of action and agency and her most recent attempt to address the normative question. Thomas Reid has the unusual distinction of arriving at a metaethical position very much like G. E. Moore’s via a route very similar to that employed by the Kantians. That is, Reid embraces a version of nonnaturalist moral realism by appeal not to open question-style considerations but to a particular account of agency. In this essay, we reconstruct Reid’s agency-centered argument for his constitutivist version of moral nonnaturalism, highlighting its commitments. Having presented Reid’s argument, we close by considering a prominent (...) contemporary Kantian view, namely, Christine Korsgaard’s, and identifying where, despite their common commitments, Reid and Korsgaard part company. The comparison, we suggest, is instructive because it allows us to see more clearly why the link between agency-centered approaches to ethical theorizing and nonrealist, constitutivist views of morality, such as Korsgaard’s, is deeply contingent. The mechanism by which the mammalian kidney creates the osmotic gradient necessary for urine concentration remains an open question. We present a brief survey of the give-and-take between theory and experiment on this question over the last half century. We start with the introduction of the countercurrent multiplier paradigm in 1951. We finish with a description of a recent suggestion that the explanation for the enigmatic inner medullary osmotic gradient may reside in the very metabolism of the inner medullary cells, (...) which are required by the region's hypoxia to obtain their ATP largely from anaerobic glycolysis and which thus, by the same token, furnish net osmoles to the medullary interstitium by convering glucose to lactate. Here, we describe how Casas Grandes Medio period (AD 1200 to 1450) shamanic practices of the North American Southwest used tobacco shamanism, a ritual stance called the Tennessee Diviner (TD) posture, and cultural expectations to generate trance experiences of soul flight and divination. We introduce a conceptual model that holds that specific trance experiences are the emergent result of human minds interacting with additional factors including entheogens, cultural expectations, physiological states, postures/movement, and sound/stimulation. Experimental and ethnographic evidence indicates initiating trance (...) with either tobacco intoxication or the TD posture accompanied with a rapidly beating drum or rattle corresponds with perceptions of soul flight, transformation, and divination/information acquisition. Both have similar results but pairing them together as they were during the Medio period likely helped ensure the culturally desired trance experiences. This practice of mutually reinforcing factors was likely part of tobacco‐based shamanism found in other New World cultures as well. We suggest our general model can be applied to other contexts to examine how various aspects of trance induction interact to produce the cultural patterns (and resulting cosmological and spiritual frameworks) anthropologists have documented in other cultures. The treatment decisions of competent adults, especially treatment refusals, are generally respected. In the case of minors something turns on their age, and older minors ought increasingly to make their own decisions. On the other hand, parents decide on behalf of infants and young children. Their right to do so can best be justified in terms of the importance of preserving intimate family relationships, rather than in terms of the child's best interests, although the child's best interests will most often (...) follow from this arrangement. The classic model of blood pressure regulation by Guyton et al. (Annu Rev Physiol 34:13–46, 1972a; Ann Biomed Eng 1:254–281, 1972b) set a new standard for quantitative exploration of physiological function and led to important new insights, some of which still remain the focus of debate, such as whether the kidney plays the primary role in the genesis of hypertension (Montani et al. in Exp Physiol 24:41–54, 2009a; Exp Physiol 94:382–388, 2009b; Osborn et al. in Exp Physiol 94:389–396, 2009a; Exp (...) Physiol 94:388–389, 2009b). Key to the success of this model was the fact that the authors made the computer code (in FORTRAN) freely available and eventually provided a convivial user interface for exploration of model behavior on early microcomputers (Montani et al. in Int J Bio-med Comput 24:41–54, 1989). Ikeda et al. (Ann Biomed Eng 7:135–166, 1979) developed an offshoot of the Guyton model targeting especially the regulation of body fluids and acid–base balance; their model provides extended renal and respiratory functions and would be a good basis for further extensions. In the interest of providing a simple, useable version of Ikeda et al.’s model and to facilitate further such extensions, we present a practical implementation of the model of Ikeda et al. IntroductionCognitive impairment is a highly prevalent non-motor feature of Parkinson’s disease. A better understanding of the underlying pathophysiology may help in identifying therapeutic targets to prevent or treat dementia. This study sought to identify metabolic alterations in the prefrontal cortex, a key region for cognitive functioning that has been implicated in cognitive dysfunction in PD.MethodsProton Magnetic Resonance Spectroscopy was used to investigate metabolic changes in the PFC of a cohort of cognitively normal individuals without PD, as well as PD participants (...) with either normal cognition, mild cognitive impairment, or dementia. Ratios to Creatine resonance were obtained for glutamate, glutamine and glutamate combined, N-acetylaspartate, myoinositol, and total choline, and correlated with cognitive scores across multiple domains administered to the PD participants only.ResultsWhen individuals retain cognitive capabilities, the presence of Parkinson’s disease does not create metabolic disturbances in the PFC. However, when cognitive symptoms are present, PFC Glu/Cre ratios decrease with significant differences between the PD-NC and PPD groups. In addition, Glu/Cre ratios and memory scores were marginally associated, but not after Bonferroni correction.ConclusionThese preliminary findings indicate that fluctuations in prefrontal glutamate may constitute a biomarker for the progression of cognitive impairments in PD. Sense of agency refers to the ability to influence one’s functioning and environment, relating to self-efficacy and wellbeing. In youth, agency may be challenged by external demands or redefinition of self-image. Music, having heightened relevance for the young, has been argued to provide feelings of self-agency for them. Yet, there is little empirical research on how music impacts adolescents’ daily sense of agency. The current study investigated whether music listening influences adolescents’ perceived agency in everyday life and which individual and (...) contextual determinants would explain such an influence. Participants were 44 adolescents (48% female, 36% with training in music, mean age 14), recruited through local schools. The mobile Experience Sampling app MuPsych was used to collect brief self-reports of personal music listening experiences during daily life. This method assessed the change in the listener’s perceived control over both their emotional states (Internal Agency), and their external environment (External Agency), over five minutes of music listening. Also measured were changes in mood states, and contextual variables (social situation, concurrent activity, and reason for listening). The impact of music on the sense of agency was analyzed using multilevel structural equation modelling. There was no general increase of agency across all music episodes, but agency fluctuations were determined by specific individual and contextual factors. Music training predicted increases in both internal and external agency during music listening, and external agency increased more for male participants. Certain context features such as listening alone, paying attention to music, and listening for enjoyment were related to greater increases in agency. Increases in agency significantly correlated with increases in mood valence. Our findings confirmed the plasticity and situational embeddedness of the sense of agency. Music indeed can support agency, but the impact is dependent on specific individual and contextual factors. Sense of agency can be seen as a health resource and significant part of youth development, and current findings provide new insight into when and by whom such affordance is likely to be employed. Drawing on positioning theory this study investigates how Somali diaspora mothers actively struggle to be recognized by teachers in Danish public schools as equitable partners in their children’s education. The study takes into account the historically and politically constituted conditions for positioning work and argues that these mothers navigate skillfully in these conditions explicitly positioning themselves as both ‘supportive assistants’ and ‘responsible parents’. However, the analysis shows that these mothers have narratives of unjust treatment of both themselves and their children (...) in schools, but the struggle to be recognized as equitable partners inhibits their possibilities of taking up the position of ‘advocate for their child’. They are thereby drawn into a position of ‘passive complacency’. Additionally the article argues for a more encompassing understanding of positioning theory that takes into account the constituted conditions as well as embodied and material aspects of constitutive here-and-now negotiations. This article aims to foreground alcohol abuse by cancer patients and explore how alcohol abuse functions as a biographic master motive and at the same time is a shadow side in the oncological field and research. The research is based on a single case study which draws on empirical material from interviews, field notes and staff policy, with analysis using Bourdieu’s concepts of trajectory of life and habitus. The findings show that the cancer patient’s alcohol abuse is an important part (...) of the trajectory of his private life and spare time. In social life with family and friends alcohol is given and normal and acts as a socialisator. Alcohol abuse provides both stability and instability in the cancer patient’s life. When cancer results in work breaks and retirement, and spare time often is used as drinking time, then all daily life becomes drinking time for the cancer patient. Alcohol is often a hidden abuse at the working place and in the oncological field. In meetings with healthcare professionals, the patient chooses not to speak about his alcohol abuse to avoid further medicalisation. The challenge for the healthcare professionals is to see and accept alcohol abusers with cancer and their social lives without always trying to change their ‘unhealthy’ lifestyles. (shrink)

This article aims to make a contribution to the conceptualization of mainstreaming gender equality promoted by the European Union. It starts by exploring the historical periodization of equal opportunities delivery strategies and challenging the compartmentalization of these developments. It suggests that equality policies can better be conceptualized in terms of a `three-legged equality stool', which recognizes the interconnectiveness of three perspectives — the equal treatment perspective, the women's perspective and the gender perspective. The article argues that the gender perspective has (...) been closely associated with strategies for mainstreaming gender equality, but that this association is misleading. As a result mainstreaming has remained a `fuzzy' concept, which in turn has led to many different styles and forms of practical implementation in European member states. (shrink)

Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. In Sartre’s 1946 article “The Humanism of Existentialism,” Sartre places existentialists into two categories, Christian or atheist, and contends that existentialism works differently for each of them. This paper argues that such a distinction should not have been made because existentialist beliefs, views, and themes do not differ based on one’s religiosity. This paper specifically examines three examples in Sartre’s article which undermine his position, and further argues that Sartre made an equivocation fallacy by conflating two different types of essence, (...) one’s innate essence and one’s character essence. The paper then explores six central existentialist themes to demonstrate that in their existentialist beliefs both the theist and the atheist agree. Those six themes are authenticity, sincerity vs. bad faith, the absurdity of life, the meaning of life, choice, and responsibility. The paper also examines the issue of moral objectivity vs. non-objectivity, and argues that not only is this not an existentialist issue, but even if it were one’s belief on moral objectivity does not cleanly correspond to one’s religious beliefs, so here again there is no basis to distinguish the Christian and the atheist. The paper concludes that any disagreement between existentialists who are Christian and those who are atheist comes down to differences in their religious beliefs, not their existentialist views. How do multiple obligations to give, to receive, and to reciprocate contribute to the evolution of international society? This question can be derived from the works of the French anthropologist and sociologist Marcel Mauss, in particular from his classic essay The Gift, published in 1925. The aim of this article is to introduce Mauss’ theory of the gift to international political theorists, to develop a general theoretical argument from his claim about the universality of gift-giving, and to lay out the (...) plan of the Special Issue. Ithaca, NY: Cornell University Press, 2002. Pp. xiii + 251. Cloth, $29.95. Important works on Dostoevsky's life and thought abound, but James Scanlan offers the first comprehensive treatment and evaluation of Dostoevsky as a philosophical thinker. Scanlan uses Dostoevsky's thousands of letters, essays, and "capacious notebooks" (3), as well as (...) his literary work, to analyze systematically Dostoevsky's philosophical worldview and to argue for its coherence. Scanlan's commitment to careful scholarship is apparent throughout, including his translations of the texts. A philosopher himself, Scanlan contextualizes Dostoevsky's work in relation to traditional philosophers, including Descartes, Kant, and Kierkegaard. The result is a balanced, rich, and provocative treatment that also suggests new interpretations of some of Dostoevsky's literary works.If Bakhtin is right to describe Dostoevsky's novels as "polyphonic," how does one ascertain their author's position? Scanlan grants the challenges of approaching Dostoevsky as a philosopher. Nineteenth-century Russian thinkers rarely identified with particular philosophical schools, and Dostoevsky never thought of himself as a philosopher. Yet Dostoevsky was intensely interested in philosophy, and Scanlan argues that Dostoevsky's characters serve as surrogates for competing philosophical positions. Scanlan also reminds readers of Dostoevsky's often-neglected nonfiction works and weaves masterfully the nonfiction and the literature to support his argument.Echoing Bakhtin, Scanlan labels Dostoevsky's methodology "dialogical in style, monological in substance" (4). Doing so effectively rejects critical perspectives that suggest the author held contradictory positions. For Scanlan, Dostoevsky's dialectical method resulted from his preoccupation with combating others' ideas, implied by his frequent use of reductio ad absurdum arguments. Dostoevsky "sought to establish his own positions by demonstrating the failure of their antitheses" (231). Not only does Scanlan persuasively demonstrate the consistency of Dostoevsky's philosophical commitments, he also challenges the appropriation of Dostoevsky by existentialists as an "irrationalist," despite Dostoevsky's "convincing portrayals of human irrationality" and skepticism concerning rationality's powers (5).Scanlan examines Dostoevsky's vision of Christianity that included a strict binary of matter and spirit, and a rejection of rational egoism and mechanism (termed "nihilism"). Dostoevsky's positive deontologism, his "law of love" (with Christ as exemplar) was, for Dostoevsky, necessary to overcome the "law of personality," and conscience grounded in Christian love was the basis for salvation. Scanlan persuasively argues that Dostoevsky, if irrationalist, belongs more with Kant than Kierkegaard in viewing rationality as limited but not to be rejected wholesale. Scanlan uses this analysis to ground a provocative new reading of Notes from Underground.Scanlan also explores the connectedness of Dostoevsky's ethics and aesthetics in Dostoevsky's insistence that artists should create moral beauty beyond the purely aesthetic or cognitive. Much has been written about Dostoevsky's aesthetics, but Scanlan exposes its logical grounding in Dostoevsky's rejection of the subjective utilitarian aesthetics of Chernyshevsky and the radical materialism of Dobrolyubov. For Dostoevsky, the need for [End Page 568] beauty and creativity is intrinsic to human nature, and art serves an epistemological function that gestures toward reality, not as a "mindless photographer" (140) but as a cognitive vision penetrating "the core of his subject" (141). Dostoevsky also justified his use of the anomalous, noting that the exceptional might be "an avenue of access to the universal" (143).Dostoevsky's "dream of a community of perfect Christian brotherhood and love" (160) grounds Scanlan's examination of Dostoevsky's sociopolitical philosophy and his rejection of the critical view that Dostoevsky's politics radically changed over time. Though Scanlan agrees with biographers that Dostoevsky despised the "moral blight" (169) of serfdom, he argues that Dostoevsky's vision of Christian society permitted social stratification so long as service to masters was voluntary, cooperative, and rational. Alternative proteins, including plant-based and cell-based meat and dairy analogues, are discursively positioned as a new form of meat and dairy and as a solution to the myriad of issues associated with conventional animal agriculture. Animal agricultural industries across various nations have resisted this positioning in regulatory spaces by advocating for laws that restrict the use of meat and dairy terms on the labels of alternative proteins products. Underlying this contestation are differing understandings of, and vested interests in, desirable futures (...) for animal agriculture. In Australia, this broader contestation led to a national-level inquiry by a Senate parliamentary committee entitled _Definitions of meat and other animal products_ (the Inquiry). This paper reports findings from a study of the problematizations developed through the Inquiry using a framework for policy discourse analysis referred to as Bacchi’s ‘What’s the Problem Represented to be’ methodology. It shows how the dominant discourse throughout the Inquiry moved away from the initial problematization of alternative proteins as a threat to animal agriculture. Instead, both industries were ultimately positioned as not in competition and only labelling laws were problematized with the solution being amendments to ensure ‘consumer clarity’. This outcome ignored a range of alternative problematizations related to the ethical, environmental, health, social and economic issues raised by animal agriculture and by alternative proteins. This lack of scrutiny benefits both industries, by closing off the policy discourse to consideration of a range of alternative interests, voices, and potential solutions, such as stricter health and welfare regulation. Approaches to self‐management traditionally focus upon individual capacity to make behavioural change. In this paper, we use Bourdieu's concepts of habitus and capital to demonstrate the impact of structural inequalities upon chronic illness self‐management through exploring findings from 28 semi‐structured interviews conducted with people from a lower socioeconomic region of Adelaide, South Australia who have type 2 diabetes. The data suggests that access to capital is a significant barrier to type 2 diabetes self‐management. While many participants described having sufficient cultural (...) capital to access and assess health information, they often lacked economic capital and social capital in the form of support networks who promote health. Participants were often involved in social networks in which activities which are contrary to self‐management have symbolic value. As a consequence, they entered relationships with health professionals at a disadvantage. We conclude that structural barriers to self‐management arising from habitus resulting in the performance of health behaviours rooted in cultural and class background and limited access to capital in the form of economic resources, social networks, health knowledge and prestige may have a negative impact on capacity for type 2 diabetes self‐management. Simone Weil was a sustained and trenchant critic of Marxism from 1930 till her death. In her writings as a philosopher she proposes a rereading of the Marxist analysis of the alienation of work, pointing to the inadequacies and illusions of Marx’s project. Whereas Marx locates the origins of alienation (defined as the human subject’s incapacity to comprehend its work) in the structure of the capitalist market, Weil is convinced that alienation stems from the very nature of the organization of (...) work. Une réflexion sur les modalités d’accompagnement des femmes primipares est abordée ici à partir de la perception qu’elles ont du soutien social fourni par leur environnement privé et professionnel. L’étude a porté sur 62 femmes primipares rencontrées au 8e mois de grossesse, un mois et trois mois après l’accouchement. Il s’avère qu’elles comptent essentiellement sur la sphère privée, notamment leur conjoint, et que les professionnels occupent une place importante lors du prénatal pour un soutien essentiellement de type informatif. The purpose of this study was to build upon previous ethical research; thereby, advancing the hospitality industry's understanding of ethical decision making in lodging operations. In particular, this study reviewed: (a) the primary normative ethical precepts (i.e., egoism, benevolence, and principle) used as a criterion in ethical decision making, and (b) the predominant locus of analysis (e.g., individual, local, or cosmopolitan referent sources) used in applying ethical precepts to ethical decisions.The sample consisted of 500 lodging operations as randomly abstracted from (...) the 1994 Hotel Travel Index produced by Reed Travel. The researcher selected full service, limited service, or as rooms-only lodging operations throughout the United States. A full service property offered guest rooms, meeting rooms, and food and beverage services. A limited service property offered a continental breakfast, small meeting facilities, and guest sleeping rooms. A rooms-only property only offered guest rooms. One solution would be found in the legal provision for the equality of rights for all the members of society, including cultural minorities, but if the legal solution alone is considered (...) effective, there would be waste of resources accumulated in cultures as enabling agents of amenable human life. But multiple cultures in a single society easily become a source of conflict, as another culture encroaching upon one’s own culture is often felt as a threatening challenge to one’s identity, as identity is constructed in the subjective process of culture. It implies the master-and-slave struggle between two subjectivities. Cultural subjectivities, personal or collective, could be induced to constitute a complex system of federated subjectivities. Even such a system would not, however, completely eliminate tension and conflict. Intervention by an ethic universally conceived on the minimal basis would meet the urgent need to prevent escalation of conflict, but it would ultimately prepare a common ground for the development of a global culture incorporating multiple cultures as historically inherited resources for enrichment of human life. Ethical awareness is what reveals the otherness of the other and also the ontological ground of human life on earth ; as ethics and epistemology coincide, a human reason would emerge as the ground of a new global culture, and the world would hopefully become a single Lebensraum for entire humanity. This paper examines the ethical conundrum between a hospital's ethos of relieving distress, investigation and treatment, and its concurrent duties under English law to administer tests of decision-making capacity and safeguarding protection where it believes the patient may lack this capacity. Delirium, characterised by a precipitous decline in mental functioning exhibiting the shared symptomology of recoverable depressive disorders and terminal dementia, is not uncommon after emergency admission of elderly patients into acute medical hospital wards. The use of functional capacity testing (...) as a benchmark for decision-making capacity for post-discharge residence has been criticised as outdated, conceptually floored, subjective, lacking central guidance, transparent process, and accountability. A study of patient experience demonstrates the potential for hospital misuse of capacity testing, the failure of functional testing to differentiate decision making capacity from the disability of partial cognitive impairment, and how hospital capacity processes can interact and amplify patient pathology thereby decreasing recovery prospects. Prioritisation of mental capacity obligations above thorough investigation of emergent mental pathology and relief of patient anguish, results in extended detention in medical wards lacking bespoke facilities. Further understanding of patient experience is needed to inform policy with interventions tailored to avoid harm and increase wellbeing. (shrink)

Challenging the new political-economic “mainstream” that considers trade unions to be “complicit” in labor market dualization, this article’s analysis of union strategies in Italy and South Korea, most-different union movements perceived as unlikely cases for the pursuit of broader social solidarity, shows that in both countries unions have successively moved away from insider-focused strategies and toward “solidarity for all” in the industrial relations arena as well as in their social policy preferences. Furthermore, unions explored new avenues of political agency, often (...) in alliance with civil society organizations. This convergent trend toward a social model of unionism is ascribed to a response of unions to a “double crisis”: that is, a socioeconomic crisis, which takes the form of a growing periphery of the labor market associated with growing social exclusion, and a sociopolitical crisis, which takes the form of an increasing marginalization of the unions from the political process. Chile and Colombia have undergone very different postconflict processes. Whereas in Chile there was an elite-based negotiated transition from a state terror regime, Colombia presents a gradual exit from an armed conflict involving multiple actors and taking place in one of Latin America’s most stable democracies. A strong common feature nevertheless exists in these two countries: important social movements—notably, student, afro-descendant, Indigenous, and peasant movements—that put forward memory, but which reach beyond the circle of direct victims. These “memory from below” (...) movements in both countries cannot be understood from their institutional contexts, since these are so different: while Chile’s democratic governments strengthened the amnesty law and led only to timid commemorative initiatives twenty years after the end of the dictatorship, Colombia adopted numerous laws that allowed an institutional presence of memory—notably, through the creation of the National Center for Historic Memory—while the armed conflict was still fully fledged. From a comparative politics perspective, these institutional differences lead one to investigate other causes for the presence of “memory from below” movements in both countries: interviews of participants show that these movements stem from a common understanding of the political role of memory, as well as from a common social imaginary of “shared suffering” that seeks to uncover state violence and that understands past human rights violations as being part of a historic continuum of structural and colonial violence aimed at criminalizing and crushing social movements in democracy. ABSTRACT Feminists look critically at any infliction of pain on others, usually requiring that it be consensual, and often both consensual and for the benefit of the person afflicted. Most torture of women is not recognized under official definitions of torture because it is not performed by or with the consent of (government) officials. Women are, however, also victims of torture under official definitions as military or civilian prisoners or as members of defeated populations in war, and are more often (...) subjected to sexual torture, which until recently has not been understood either as torture or even a war crime. Rape, especially serial gang rape, it is argued, should be understood as torture, as the essence of torture is the use of severe pain to obscure or obliterate the victim's sense of agency. (shrink)

Several Freudian texts unambiguously mark the sexualisation of desire, desire as a male principle. La Oroya, Peru, and Herculaneum, Missouri, USA, are two cities 4,000 miles apart but beset with common health and environmental risk: high levels of lead contamination. A key participant in this unfolding tale of environmental disaster has been The Renco Group, a privately held investment holding company based in New York. This case study sheds light on The Renco Group’s Corporate Social Responsibility (CSR) in a developing country (Peru) as distinct from CSR in a developed country (USA) by presenting the (...) distinctive set of formal and informal forces that shape the ethical outcome. The question – one which animates much of this case – is what mechanisms exist that work either collectively or individually to encourage or even require a privately-owned firm to act in a socially responsible manner or, more modestly, to cease activities that are deemed to harm society or the general welfare in a multi-country context?
